The office

A Spanish-speaking notary in Montréal

Oscar Fernandez Garcia works with clients in Spanish, French or English, whichever they prefer. For someone whose first language is Spanish, it means understanding every clause of a deed before signing it, in the language they ask questions in most easily.

Understanding what you sign, in your own language

A notarial deed commits you for a long time: buying a home, a will, a protection mandate. The notary has to make sure each party understands what they are signing. When the explanation is in your language, questions come more easily and nothing is left unclear.

Meetings and documents are in French, English or Spanish, as you prefer. If a relative coming with you speaks another of these languages, let us know when you book.

A notarial system you may already know

If you come from Spain or Latin America, the role of the notary in Quebec will feel familiar. Quebec follows the civil law tradition, like most Spanish-speaking countries, and its notary is a public officer: the deed they receive is authentic, and the original is kept on file at their office.

The rules, however, are Quebec’s. A will, a marriage contract or a power of attorney made abroad does not always have the expected effect here. If you have a document like this, bring it to the meeting: we will look at what it provides and whether it needs to be completed.

The most common matters

Every service the office offers can be handled in Spanish, including:

  • buying, selling or refinancing a house, condo or plex;
  • a notarial will;
  • a protection mandate;
  • settling an estate;
  • a power of attorney;
  • a civil marriage or a common-law partnership agreement;
  • travel consent for a minor child.

Before your appointment

Book by phone at 514-508-1099 or through the contact form, in Spanish if you prefer. Tell us what brings you in: we will let you know which documents to bring.

If some of your documents were issued abroad (birth or marriage certificate, divorce judgment), mention it when you book. We will tell you whether a translation or another formality is needed.
